July 25, 2023 New Laws Impacting Manufacturers: Changes are Coming to Illinois' Day and Temporary Labor Service Act and Equal Pay Act

Description

Two bills that passed the Illinois General Assembly this spring have been sent to Governor Pritzker for his signature and will have major implications for Illinois manufacturers, who will need to know how to comply with these pending laws.

HB 2862 amends the Day and Temporary Labor Service Act and will impact manufacturers who utilize staffing and temp agencies. Among other things, the bill requires businesses to provide staffing agencies with detailed information about the job positions, and then requires that temporary employees be paid the same rate as other employees after 90 days of service. The bill also prevents staffing and temp agencies from assigning job seekers to facilities who may be dealing with a strike or lockout, giving the job seekers a right of refusal for placement.

HB 3129 amends the Illinois Equal Pay Act regarding information provided by employers in job positing. The bill requires manufacturers to include a pay scale and disclose benefits in all open job postings.
