Understanding the Supreme Court’s IEEPA Tariff Ruling and What Comes Next

Late last month, the Supreme Court ruled that tariffs imposed under the International Emergency Economic Powers Act (IEEPA) are unlawful.

Following that decision, on March 4, 2026, the Court of International Trade directed U.S. Customs and Border Protection (CBP) to begin issuing refunds to importers who previously paid IEEPA duties.
